1. Agreement

These Terms govern your use of shop.dreamersmarkets.com (the “Marketplace”), operated by Dreamers Markets (“Dreamers Markets,” “we,” “us”). By using the Marketplace or placing an order, you agree to these Terms and to our Privacy Policy.

2. The Marketplace

Dreamers Markets is an online marketplace where independent makers (“Makers”) list and sell their own products. Makers are independent sellers, not employees or agents of Dreamers Markets. We facilitate the sale: we host the listings, process payment, collect and remit applicable sales tax as the marketplace facilitator, and provide order support. Items are made and shipped by the Maker.

3. Your account

You’re responsible for the accuracy of your account information and for keeping your login secure. You must provide a valid email and shipping address to order.

4. Orders, pricing & payment

Prices are shown in U.S. dollars. We may correct pricing or description errors and cancel affected orders. Payment is processed by Stripe; by ordering you authorize the charge for the items, shipping, and applicable tax. As the marketplace facilitator, Dreamers Markets collects and remits applicable California sales tax.

5. Shipping & returns

Shipping and returns are governed by our Shipping and Returns & Refunds policies, which are part of these Terms.

6. Acceptable use

Don’t use the Marketplace to break the law, infringe others’ rights, interfere with the service, scrape or misuse data, or attempt to gain unauthorized access. We may suspend access for conduct that harms the Marketplace, Makers, or other shoppers.

7. Intellectual property

The Marketplace, including its design, logos, and content we provide, is owned by Dreamers Markets or its licensors. Product listings, images, and descriptions are provided by Makers, who are responsible for them. You may not copy or reuse content without permission.

8. Disclaimers

The Marketplace is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Marketplace will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Dreamers Markets will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing here limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify Dreamers Markets against claims arising from your misuse of the Marketplace or your violation of these Terms or applicable law.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in [County], California, unless your counsel adopts an alternative dispute-resolution process.

12. Changes

We may update these Terms; the “last updated” date will change and continued use means you accept the update.
